We are not able to put a checkbox on the Referrer register page. It's not so much legal reasons, it has more to do with the template and design of the page.
We are showing this page to existing customers who have already made a purchase and they may have been given the option already on your website to opt in to your newsletters.
So by not showing the checkbox here, we are avoiding to overwhelm the customer with the newsletter sign up info.
